Amanda Bynes Bong-Tossing Case Dismissed if Actress Agrees to 6 Months Counseling

Amanda Bynes may actually be putting her bong-tossing case behind her.

According to People magazine, a judge will dismiss the marijuana possession charges against the actress, if she agrees to stays out of trouble for six months and attend counseling sessions twice a week. If she complies the charges will not appear on her records.

The 27-year-old star was arrested on May 23 and was charged with "tampering with physical evidence, reckless endangerment and criminal possession of marijuana," according to NYPD spokesman Det. Brian Sessa. Bynes reportedly threw a bong out of her Midtown 39-floor apartment window, after police showed up in response to a call about the actress smoking pot in the lobby of her apartment and behaving disorderly.

"There was a 911 call at her apartment building that someone was smoking marijuana in the lobby," Sessa said. "There was a heavy smell of marijuana. [Then] she took the bong and threw it out the window."

Bynes did not appear in court, but her attorney Gerald Shargel appeared on her behalf and told reporters outside of the courthouse that Bynes could not be happier with the outcome.

"This is an important step in her rehabilitation and she is pleased with the result," Shargel said.

Shargel was given until the next court date on, June 30, to file an affidavit that states his clients understanding of the terms of the agreement and will complete her counseling requirement.  

Last year, the "All That" actress was released from an inpatient mental health treatment facility in California after being placed on an involuntary psychiatric hold for setting a small fire on a household driveway in Thousand Oaks, Calif.

"Despite the fact Amanda is no longer in a facility, her outpatient treatment is continuing," family attorney Tamar Arminak told ABC News, after Bynes release. "She's very happy to reestablish the loving relationship with her family that she once shared."

The "What A Girl Wants" star is currently under the custody of her parents, Rick and Lynn Bynes, and has reportedly enrolled for the winter quarter at the Fashion Institute of Design & Merchandising in Orange County.
