Food Supplier Files Lawsuit Against Egg Farm Due To Breach Of Contract

A food company in Des Moines, La is suing an egg farm in Iowa due to a breach of contract that the farm had with them since bird flu incident stopped their provision of eggs.

The Des Moines Register reported that it was Michael Foods Eggs Products Co., who is filing a lawsuit against Hawkeye Pride Egg Farms located in Corwith, for their breach of contract made on the 7th of January last year. The lawsuit states that the breach done by the egg farm will cause negative results to Michael's company. And now that it's the case, the company's losses due to their breach on the supply has been declared irreparable.

The Associated Press went into the details of the lawsuit and although most of the information is confidential, they found out that the losses of Michael's company went more than $75,000. Basically, Michael Foods are demanding that the egg farm to not breach their contract when it comes to the supply of the eggs that they have agreed last year. And so far, it was looking like the farm is not able to meet at the end of their agreement and this is why this whole lawsuit happened.

According to ABC News, Michael Foods is a sub subsidiary of a cereal-making company called Post Holdings Inc. and they confirm that the suffering happening on Michael's ends is indeed something that can't be fixed. The lawyer of the company refused to make any comments about the issue. Michael Foods is responsible for liquids and other raw egg products. On the other hand Hawkeye Pride is a division of Sioux Center-based Center Fresh Group, which apparently was affected when bird flu hits its farm making them lose 5.5 millions of hens. None of both parties' lawyers would like to say something about the whole thing.
