Usher's ex-wife Tameka Raymond as filed for custody of their two children following Monday's pool accident which left their five year-old son Usher Raymond V in a com, according to the New York Daily News.

According to the police report obtained by "Entertainment Tonight," the young boy was playing around the pool area under the supervision of his aunt Rena Oden. While playing, he fell into the bottom of the pool and his arm became stuck in the drain. Rescue attempts from Oden and the housekeeper where unsuccessful. The boy was later pulled out by two subcontractors, who revived Usher's son and performed CRP. CNN identified the two men as sound technicians.

Tameka who divorced the singer November 2009 filed legal documents on Tuesday asking for an emergency hearing on grounds that Usher is allegedly creating a "dangerous environment" for the children. The Daily Mail also reported Tameka's claims of Usher "abdicating his parental responsibilities by letting other people care for their two children,"

According to the Daily Mail, Usher was reportedly not home during the incident, but when notified, was said to have promptly rushed to his Atlanta property. He rode in the ambulance with his son. Usher Raymond V is currently being treated in the ICU at an Atlanta, Georgia hospital.

Usher currently has primary custody for his sons, Usher Raymond V and 4-year-old Navoyd. Tameka has limited custodial rights after they split. During custody arguments, the singer labeled his ex-wife as "incapable of being a proper parent to their children" and that she did not have enough emotional stability to bond with them.

Before the ambulance showed up, Oden made a frantic phone call to 911. TMZ posted an audio recording.

"My nephew was in the pool," Oden tells the 911 operator. "I tried to get him... They got him right now out there with CPR."

"Is he coming around?" she is heard being asked.

"He's breathing!" she told the operator.

The incident comes a year after Usher's stepson Kile Glover died after being hit by a jet ski.
