Tracy Morgan Files Lawsuit Against Wal-Mart After Tragic Car Crash

'Saturday Night Live' star, Tracy Morgan sustained broken nose, ribs and leg when the limousine van he was riding was hit from behind by a Wal-Mart truck in New Jersey Turnpike on June 7.

One of the passengers, Morgan's fellow comedian, James McNair, also known as Jimmy Mack was left dead. Aside from McNair, other passengers include Comedian Ardley Fuqua Jr. and Morgan's personal assistant Jeffrey Millea were also severely injured.

After filing a lawsuit in U.S. District Court in New Jersey upon his release from his rehabilitation, Wal-Mart allegedly filed a complaint saying that Morgan and the rest of his friends including the one who died in the fatal car crash were not wearing seatbelt when the accident happened.

Tracy Morgan on the other hand filed a statement in response to the allegations of Wal-Mart. Last week, Morgan, who was critically harmed in the accident, filed a negligence suit against the retail giant company.

"After I heard what Wal-Mart said in court I felt I had to speak up," Morgan stated. "I can't believe Wal-Mart is blaming me for an accident that they caused. My friends and I were doing nothing wrong. I want to thank my fans for sticking with me during this difficult time. I love you all. I'm fighting hard every day to get back."

The suit states that Wal-Mart was 'careless and negligent' in the ownership and operation of its tractor-trailer, as its trailer hit the back of Morgan's limousine. Comedian James McNair, one of Morgan's passengers died as a result of injuries he sustained in the crash.

It also indicates that Morgan and other passengers had sustained multiple fractures needing major physical rehabilitation, multiple surgeries, and extensive medical treatment.

The statement also claims that Kevin Roper, the 35-year-old truck driver fell asleep while driving, and that the 'collision avoidance technology' failed to employ the brakes.

Roper faces five criminal charges in New Jersey including one count of death. He pleaded not guilty for the case.
