Katy Perry Left Shark: Super Bowl Meme NOT Trademarked By ‘Roar’ Singer

Back in February, the "Dark Horse" singer took the biggest stage in the United States (and possibly the world) to perform on the Super Bowl Halftime Show, but it was Katy Perry's Left Shark back-up dancer who took all the credit, looking disoriented during the performance and turning into an instant Internet meme.

Following the show, Food World News reported that the rage for the Katy Perry Left Shark was so broad and instantaneous that the singer's lawyers had to keep people all over the world from selling items to the costumed dancer's look, as they attempted to get the meme trademarked.

Nearly three months after the original Katy Perry Left Shark performance, it seems like the singer has little to no rights over the image when it comes to its trademark, even after launching a Katy-themed onesie with the famous back-up dancer - not that Katy needs the money, anyway.

According to Hollywood Reporter, following the Super Bowl, the singer and her lawyers attempted to capitalize further on Katy Perry's Left Shark, taking the image and several phrases related to the performance (including the aforementioned "Left Shark," plus others like "Right Shark," Drunk Shark" and even "Basking Shark") to the patents office to ask for it to be trademarked under the brand that is the "California Gurlz" singer.

According to Consequence of Sounds, the US Patent and Trademark Office has recently decided that Katy Perry's Left Shark "don't instantly connect" with the star's performance, neither when it comes to her singing nor her dancing act, and she's been denied the request to trademark the already-famous outfit.

"[the design] identifies only a particular character; it does not function as a service mark to identify and distinguish applicant's services from those of others and to indicate the source of applicant's services," wrote Dave Collier, the trademark examiner who denied Katy Perry's Left Shark request, according to BBC.
